Defense Verdict in Stairwell Fall Case

Attorney Sysak Obtains Defense Verdict in Stairwell Fall Case

Andrew Sysak recently obtained a defense verdict in Allegheny County with respect to a trip and fall case where the Plaintiff asserted that she tripped on a composite wood step that was negligently constructed and/or maintained by the property owner.  As a result of the incident, the Plaintiff suffered a broken ankle which required surgery and hardware placement.  The Plaintiff also sought a wage loss claim in excess of $50,000.00.

The Plaintiff presented expert testimony that the composite wood steps were negligently constructed, fell outside of applicable building codes, and also created a dangerous condition where there was a small height differential between the wooden planks of the step at issue.

Plaintiff was extensively cross-examined with respect to numerous inconsistent statements and descriptions of the accident.  Moreover, expert testimony was presented which further demonstrated that the steps were property constructed and maintained in accordance with the applicable codes.  After a three (3) day jury trial, a 12 to 0 verdict in favor of the property owner was entered.
